The terms and conditions of sale constitute a legally binding agreement, protecting your rights as a customer and ours as a company. It is very important that you read these terms and conditions before making a payment.

TERMS AND CONDITIONS OF PURCHASE

Order:

When you place an order on superlativa.co, you hereby accept the prices, product descriptions and general sales terms. You also undertake to provide us with true and valid data, including you e-mail address, postal address and any other data that is necessary to process your order in the correct manner and to be able to contact you if necessary. Failing this, we will not be able to process your order correctly.

When you place an order on superlativa.co, you also guarantee that you are fully authorised to use the debit or credit card you provide us with to make the payment. We may need to contact you to verify the information you provide.

Order and invoice confirmation:

Once you have placed your order and payment has been confirmed, we will send you a confirmation of the order by e-mail. If you can’t see the confirmation e-mail in your inbox, please remember to check your spam folder. Or, if you use Gmail and your confirmation e-mail has been sent to your “promotions” tab, you can drag it to the “main” inbox tab to make it easier for you to access the information we send out.

Product availability:

Orders will be subject to product availability. If we have supply difficulties or if there are no items in stock, we will let you know when the product will be available again, in addition to the possibility of buying similar products of an equal or higher value. If you do not wish to order a substitute product or to wait until we receive new stock of the product you have ordered, we will refund you the total amount paid.

Delivery:

We undertake to deliver your products in perfect condition to the delivery address provided during the purchase process. We will provide you with information at all times so that you can track your order and the time of delivery.

Product recall and modifications:

We reserve the right to withdraw any of our products from our website at any time, as well as to remove or modify materials or contents thereof, for any reason whatsoever and without prior notice.

Product prices:

The prices of all our products will be published and available at all times on superlativa.co and will include VAT. Delivery costs will be calculated in the final phase of the purchase process, when you select the delivery country or location. The price must be paid in full at the time of purchase.

Although we reserve the right to modify the price of the products for sale on superlativa.co, the price that we charge or refund you will be the price published in the product file at the time of purchase.

Payment:

Payment for orders may be made using the following methods:

VISA, MasterCard, AMEX, Maestro, ShopPay, Apple Pay, Google Pay, and PayPal. We reserve the right to modify, add or remove payment methods, without the user being able to lodge any claims for this reason.

Your card will be charged in real time via our payment gateway, after confirming the authenticity of the data via the corresponding financial institution. We will not be liable in the case your credit or debit card issuer does not authorise the payment.

We also reserve the right to take any action we deem appropriate, including cancelling the order, charging any additional fees or blocking users if suspicious or fraudulent activity is observed.

Delivery methods

Our delivery method is courier service. Products are shipped using SEUR and its European partners, and we can ship within 24–48 hours of the order being placed for mainland Spain. For others areas of Spain, it may take between one (1) and five (5) days.

Delivery costs

- EUROPEAN UNION:
19.90 EUR for orders with a total value less than 80 EUR.
FREE on orders with a total value over 80 EUR.
- COUNTRIES OUTSIDE THE EUROPEAN UNION:
19.90 EUR for orders with a total value less than 100 EUR.
FREE on orders with a total value over 100 EUR.

Cancellations, exchanges and refunds:

RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within 30 calendar days, without providing justification therefor. The withdrawal period ends 30 calendar days after the day on which you or a third party, other than the carrier and indicated by you, acquires material possession of the items.

 In order to exercise your right of withdrawal, you must notify us of your decision to withdraw from the contract by emailing us at super@superlativa.co. In order to comply with the deadline for withdrawal, it is satisfactory that you send the notification to exercise this right before the withdrawal period expires.

CONSEQUENCES OF WITHDRAWAL

In the case that you withdraw from the contract, we will refund all payments received from you, including delivery costs (excluding any additional costs resulting from having selected a delivery method other than the least expensive standard delivery method we offer) without undue delay and, in any case, no later than 30 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make said refunds using the same payment method used by you in the initial transaction, unless you have expressly specified otherwise. In any case, you will not incur any charges as a result of said refund.

We may withhold the refund until we receive the items or until you have provided us with proof of return of the goods, depending on whichever condition is met first.

You must return or deliver the items directly to us at our warehouse located at Carrer Bilbao, 8 El Masnou 08320 (Barcelona, Spain), without undue delay and, in any case, no later than 30 calendar days from the date on which you notify us of your decision to withdraw from the contract. This deadline shall be deemed to have been met if you return the items before the aforementioned period concludes. Please note that you are responsible for the direct cost of returning the items.

You will only be held liable for a decrease in value of the items if said decrease results from handling other than that considered necessary to ascertain the nature, characteristics and functioning of the goods.

PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL

The right of withdrawal shall not apply to contracts relating to:

The supply of items manufactured in accordance with the specifications of the consumer and user, or items that have been specifically personalised.

The supply of sealed items that are not suitable for return due to health protection and hygiene reasons and that have been opened after delivery.

SPECIFIC FEATURES FOR SUBSCRIPTION PURCHASES

SUPERLATIVA offers subscription as a purchase option, as the treatment products it sells are for continuous use. In order to subscribe, you must create a user with an e-mail and password, and accept the monthly recurring payment via the chosen payment method.

You can access your profile to change your subscription, add or remove products, change your payment method, change your delivery day, etc. Delivery is free of charge.

CANCELLING SUBSCRIPTION PURCHASES

The minimum period for customers who sign up to our subscription service is more than one month. In other words, you must receive at least two products: the product you receive as soon as you subscribe, and the product you receive the second month of subscription. Once the first month has elapsed and after you have received the second delivery of products, you can cancel your subscription by giving at least 15 days’ notice in advance of the charge for the next monthly payment.

Applicable law and jurisdiction

This contract is governed by Spanish Law. Any disputes that arise from the validity, interpretation, execution, termination, or other circumstances of this contract shall be subject to the jurisdiction of the courts of Barcelona.
